Terms and Conditions
BELOW ARE THE BASIC TERMS AND CONDITIONS FOR ANY SERVICES RENDERED BY EDUXPERT. TERMS CAN ALSO BE STIPULATED IN EDUXPERT’S PROPOSALS. BY ACCEPTING EDUXPERT’S PROPOSAL, THE CLIENT AUTOMATICALLY ACCEPTS THESE TERMS & CONDITIONS:
• Proposals are free of charge and the CLIENT is under no obligation until the proposal is accepted by the CLIENT.
• Proposals are valid for 30 days from the date on the proposal, unless stated differently on the proposal.
• Prices on estimates are not binding.
• EduXpert’s fees are payable in full before work commences.
• EduXpert’s advertising service includes copywriting for, sourcing images for, and creating and managing Meta advertising (on Facebook and Instagram). EduXpert’s service does not include newsletter copywriting, newsletter software setup, domain registration, website hosting, or website building – these will be quoted for on an ad hoc basis.
• CLIENT must ensure they hold the copyright for all material supplied to EduXpert. Under no circumstances will EduXpert be held responsible for any copyright disputes.
• The Date of Completion (DOC) of a project is affected by feedback and receiving of content and timelines will be adjusted accordingly.
• We cannot be held responsible for delays outside of our control, e.g. equipment failure, weather.
• We have the right to use any blog articles, content created and designed in promotional material and for other purposes anywhere else for EduXpert.
• Ongoing Monthly work (e.g. Website Maintenance/Online Marketing, etc.) will be billed for monthly and is payable in advance and within 7 days of invoice date.
• If a project is cancelled at any time, no refunds will be provided. However, EduXpert will issue a credit for fees pertaining to any outstanding ad spend budgeted but not yet spent, which the CLIENT can use in a future project.
• All work remains the property of EduXpert until final payment is received.
• We endeavour to make websites that perform well in current major browsers, but cannot guarantee backwards compatibility.
• If the CLIENT uses a service provider on EduXpert’s recommendation, CLIENT will enter into an agreement directly with them. EduXpert will not be held responsible for their service or lack of.
• Authorisation – The CLIENT authorises EduXpert to perform services on the CLIENTS’ behalf, which may include, but is not limited to, registering their domain, accessing their hosting account and disk space, creating databases and applications, managing their online advertising, and submitting their project to search engines.
• EduXpert does not do the hosting etc and does not have control over the status of hosting, domain renewals or email. All technical aspects of websites must be referred to CLIENT’s service provider. We will, however, request feedback from CLIENT’s provider via email if CLIENT need assistance. This time may be billed.
• Costs and Fees – Changes and additions to our fees will be quoted and invoiced to the CLIENT. The CLIENT will be advised of all costs, changes and additions. Any monthly packages or agreements are subject to change, but the CLIENT will be given reasonable notice.
• Payment – The CLIENT agrees to pay EduXpert in accordance with the terms specified in each proposal/estimate. Payment is due within 7 days from the date of Invoice. If the CLIENT fails to pay any invoice, EduXpert reserves the right to withdraw the website and associated materials or refuse completion and/or delivery of work until past due balances are paid. All materials or property belonging to the CLIENT, as well as work performed, may be retained as security until all just claims against the CLIENT are satisfied. The CLIENT is responsible for any debt collection, legal or court fees which may come due.
• Compliance – Under no circumstances will EduXpert be held responsible or be held liable for Facebook rejecting the CLIENT’s adverts, restricting the CLIENT’s page from advertising, or disabling the CLIENT’s advertising account.
• Earnings – Earnings and income representations made by EduXpert are aspirational statements only of CLIENT’s earnings potential. The success of EduXpert, testimonials and other examples used on its website are exceptional, non-typical results and are not intended to be and are not a guarantee that CLIENT or others will achieve the same results. Individual results will always vary and CLIENT’s will depend entirely on CLIENT’s company and its products, the economy, the normal and unforeseen risks of doing business, and other factors.
• EduXpert is not responsible for CLIENT’s actions. CLIENT are solely responsible for CLIENT’s own moves and decisions and the evaluation and use of our products and services should be based on CLIENT’s own due diligence. CLIENT agree that EduXpert is not liable to CLIENT in any way for CLIENT’s results in using our products and services.
• Changes to this Policy – EduXpert reserves the right to change this policy at any time. Please check this page periodically for changes. CLIENT’s continued use of our site following the posting of changes to these Terms & Conditions will mean CLIENT accepts those changes. Information collected prior to the time any change is posted will be used according to the rules and laws that applied at the time the information was collected.
